RHINO-RACK DEALER INCENTIVE PROGRAM
Terms and Conditions
These terms and conditions apply to all Participants participating in the Incentive Program. By participating in the Incentive Program, the Participant agrees to be bound by these terms and conditions.
“Incentive Program” means the incentive offered by the Promoter to the Participant in relation to the running of the Promotional Campaign through the Participant with the Reward offered to the Participant by the Promoter on these terms and conditions
“Participant” means a salesperson who has been invited by the Promoter to participate in the Promotional Campaign
“Participant Store” means a store of the Participant
“Promoter” means Rhino Rack Australia Pty Limited (ABN 63 122 680 639) of 22A Hanson Place Eastern Creek NSW 2766
“Promotional Campaign” means the promotion known as Win this Polaris Dealer incentive to be run by the Promoter through the Participant who sells the Promoter’s products to an end user, and which is to take place during the period between 1st October 2024 and 31st December 2024 with the prize being a Polaris Xpedition XP Ultimate provided by Polaris Sales Australia Pty Ltd., trading under ABN 62 088 081 949.
“Reward” means the reward offered by the Promoter to Participants for participation in the Incentive Program, being a Polaris Xpedition XP Ultimate + selected accessories and as further detailed in clause 14.
1. These terms and conditions apply to the Incentive Program and are binding on the Promoter and each Participant. The Participant acknowledges that it has read and accepts these terms and conditions and agrees to abide by them.
2. Entry is only open to Australian residents who are aged 18 and over.
3. The Incentive Program is conducted at the sole discretion of the Promoter. The Promoter, acting in good faith, reserves the right to withdraw, cancel, or vary the Incentive Program at any time and the Participants shall have no claim for any loss or damage against the Promoter whatsoever.
4. The Promoter has the right to audit all Participants during or following the completion of the Incentive Program and the Participant agrees to provide all books and records as required by the Promoter to conduct the audit relating to the Promotional Campaign and the Incentive Program. If in the reasonable opinion of the Promoter:
a. the Participant and/or the Participant Store has engaged in misleading or deceptive conduct, false representations or any fraudulent activities, or is in breach of statute or any requirements imposed by law;
b. the Participant has breached these terms and conditions and is tempering with the Incentive Program; and/or
c. any discrepancies or non-compliance have been identified by the Promoter during the audit, the Promoter may disqualify the Participant from participation in the Incentive Program and from receiving the Reward, and terminate these terms and conditions effective immediately. If the Participant is disqualified for any reason, then they will not receive the Reward.
5. Entry to the Incentive Program is available by invitation from the Promoter only. If the Participant agrees to enter the Incentive Program and participates in running the Promotional Campaign, it becomes eligible to receive the Reward in accordance with these terms and conditions.
6. If this Incentive Program is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its absolute discretion and to the fullest extent permitted by law: (a) to disqualify any Participant; and/or (b) to modify, suspend, terminate or cancel the Incentive Program, as appropriate, including revising or cancelling the Reward.
7. Failure by the Promoter to enforce any of its rights does not constitute a waiver of those rights.
Participation in the Incentive Program
8. The Incentive Program is available and applies during the Promotional Campaign only. Entry is only open to Australian residents who are aged 18 and over.
9. The process of participation in the Incentive Program is as follows:
a. A salesperson who sells a Promoter product through a Participant Store submits an entry in the Promotional Campaign nominating the Participant Store as the place of purchase;
b. The salesperson receives 1 bonus entry for every sale over $400 they sell on the Promoter products in one transaction;
c. At the end of the Promotional Campaign, all bonus entries submitted by the salespersons are reviewed by the Promoter and the winner randomly selected. The draw will take place on Thursday, 16th January 2025 at 11:00am at 22A Hanson Place, Eastern Creek NSW 2766.
d. If the prize is not claimed within a reasonable period, the Promoter will draw another winning ticket. The redraw will take place on Thursday, 6th February 2025 at 11:00am at 22A Hanson Place, Eastern Creek NSW 2766.
e. Notification: the winner of any draw will be notified in writing within seven days of the major prize draw and unclaimed prize draws as per the dates listed above. The winner will be notified by phone call and email.
f. Subject to compliance with these terms and conditions, the Promoter will deliver the Reward to the Participant;
g. Publication: the winner’s details (last name, first initial and postcode) will be published on the Rhino-Rack website and on the company’s Social Media channels (Instagram and LinkedIn) within 30 days of the major prize draw and/or unclaimed prize draws.
Reward
10. There is only one Reward available in the Incentive Program and only one Participant will be awarded such Reward.
11. The Reward is organised and provided by Rhino Rack Australia Pty Limited (ABN 63 122 680 639) in collaboration with Polaris Sales Australia Pty Ltd., trading under ABN 62 088 081 949.
12. The Reward is awarded randomly from all submitted bonus entries.
14. The Reward is:
a. Polaris Xpedition XP Ultimate valued at $45,495 (each referred to hereto as a “Polaris”);
b. Rhino-Rack and MAXTRAX accessories as specified: Rear Bed Rack and Roof Rack, STOW iT Utility Holder, Spade, Recovery Track Backet, Cargo Case 48L, Cargo Corner Brackets, MAXTRAX Mini Recovery Boards, MAXTRAX Recovery Kit Beach, MAXTRAX Vehicle First Aid Kit, TRED Storage Box 65L, TRED Storage Box 25L
c. the details of the Prize can be found at www.rhinorack.com/win;
d. the Prize is non-transferable and not redeemable for cash;
15. The Promoter reserves the right, at any time, to verify the validity of the two nominated employees of the Participant Store (including name, age and place of residence).
Disclaimer of liability
16. Except for any liability which cannot be excluded by law, each Participant agrees to release and hold harmless the Promoter (including its officers, employees and agents) for, from and against all liability (including negligence) arising in any way out of the Incentive Program including but not limited to the following:
a. any incidents, accidents, loss, damage, delays, cancellation and any claim whatsoever in connection with and in relation to the Reward and the Trips;
b. any claim for property damage, personal injury or death in relation to and in connection with the Reward and the Trips;
c. any theft, unauthorised access or third party interference;
d. any information including purchase data that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the control of the Promoter;
e. any variation or cancellation of the Reward or the Reward value to that stated by the Promoter;
f. any tax liability incurred by a Participant and/or the Trip recipient under clause 14 in relation to the Reward or the Trip, including Fringe Benefit Tax;
g. participation in the Incentive Program; or
h. the awarding, receipt, possession, and/or use or misuse of the Reward and the Trip, including any traveling related thereto.
Privacy
18. The Promoter collects personal information in order to conduct the Incentive Program, which information shall be used in accordance with the Promoter’s privacy policy, which can be found at www.rhinorack.com/privacy-policy. Individuals should direct any request to opt out of marketing, access, and update or correct information to the Promoter.
